Terms of Service

These Terms of Service (the "Terms") govern your use of the PrideConnect mobile application and related services (the "Service") operated by [Legal Entity Name — to be appointed before submission] ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

This document is the user-facing summary of our legal terms. The legally-final version (incorporating local-law overrides for residents of the EU, UK, India, California, and other jurisdictions with mandatory consumer-protection provisions) will be posted here in full at first public beta, after review by qualified legal counsel.

1. Eligibility (18+ ONLY)

PrideConnect is for adults aged 18 and older. There are no exceptions.

By creating an account, you represent and warrant that:

• You are at least 18 years old.
• The date of birth you provided at signup is accurate.
• You have the legal capacity to enter into a binding contract in your country of residence.
• You are not on a sanctions list, and your use of the Service is not prohibited by export controls or applicable law.
• You have not been previously banned from PrideConnect.

If we discover that an account belongs to a person under 18, we will delete that account immediately, block the device fingerprint, and report any CSAM exposure to NCMEC and relevant national authorities.

2. Your account

• One account per person. Multiple accounts, impersonation accounts, and "burner" accounts created to evade bans are prohibited.
• Your credentials are yours alone. You are responsible for all activity on your account. Notify us immediately at safety@prideconnect.lgbt if you suspect unauthorized access.
• Real you. Your profile must reflect a real human being — you. Catfishing, impersonation, and use of someone else's photos are violations.
• Accuracy. You agree that information you submit is accurate to the best of your knowledge, and you'll keep it accurate.

3. Acceptable use

You agree not to use the Service to:

• Post, send, or share any content that depicts, exploits, or facilitates the abuse of minors. This is a zero-tolerance, immediately-bannable, criminally-reportable offence.
• Post or send non-consensual intimate imagery (NCII), AI-generated intimate deepfakes of real people, revenge content, or doxxing material.
• Harass, threaten, stalk, or incite violence against any person or group.
• Engage in human trafficking, sex trafficking, or commercial sexual solicitation in jurisdictions where prohibited.
• Post content that promotes terrorism, violent extremism, or coordinated harm.
• Post hate speech targeting protected characteristics — including LGBTQ+ identities. PrideConnect is a platform for the LGBTQ+ community; LGBTQ-phobic content (including from people who claim to be community members) is removed.
• Distribute spam, malware, phishing links, or unauthorised commercial promotions.
• Impersonate others, including fictitious or deceased persons.
• Sell, trade, or transfer your account or access to it.
• Scrape, reverse-engineer, or programmatically access the Service except via documented APIs (we do not currently publish a public API).
• Use the Service while in violation of any applicable law in your country, state, or city of physical presence at the time of use.

Adult content (consensual nudity, adult-themed conversations, adult dating activity) is allowed within the in-app NSFW preferences and the law of your jurisdiction. We are an adult dating platform; we do not pretend otherwise. See [Child Safety Policy § 9] for our LGBTQ+-specific content allowances.

4. User-generated content

You retain ownership of the photos, messages, profile text, and other content you create on PrideConnect ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and (for moderation purposes only) review your User Content as strictly necessary to operate the Service. This licence ends when you delete the content or your account, except where retention is required by law (e.g. CSAM-incident records under 18 USC § 2258A).

We do not claim ownership of your photos and we will never use them for facial-recognition training, advertising, or sale to third parties.

5. Content moderation, suspension, and termination

We may suspend or permanently terminate your account, with or without notice, if we determine in good faith that you have violated these Terms or applicable law. Specific actions:

• Warning — for first minor violations.
• Suspension — 7 days for repeated or moderate violations.
• Permanent ban + device-fingerprint block — for CSAE, NCII distribution, harassment, terrorism, ban-evasion, or repeat moderate violations.
• Immediate ban + LE referral — for CSAM (auto via Cloudflare CSAM Tool + NCMEC report), credible threat of imminent harm.

You may appeal any moderation decision within 7 days via Settings → Safety & Help → Appeal a Decision. A human reviewer (not the original moderator) re-reviews. See [Child Safety Policy § 7].

You may close your account at any time via Settings → Account → Delete Account. We delete account data within 72 hours and purge from backups within 30 days, except for legally-mandated retention (see [Privacy Policy § 9]).

6. Paid features (Super Coins + Event commission)

If/when paid features are introduced (Super Coins for in-app purchases, event-ticket commission flow), purchases are processed by Apple In-App Purchase (iOS), Google Play Billing (Android), or third-party providers we engage (Stripe, Razorpay). Their refund policies apply. We do not control App Store / Play Store refund decisions and direct refund requests should go to the relevant payment provider first.

Super Coins (when implemented) are a non-refundable, non-transferable in-app credit. They expire only upon account closure. They have no cash equivalent value.

For event-ticket commissions: we charge the event organiser a 10% commission on event-ticket revenue. End users pay only the ticket price; we do not bill end users separately.

7. Intellectual property

The PrideConnect name, logo, app design, code, and proprietary features are owned by us. You may not copy, distribute, or create derivative works of these without permission. Our open-source dependencies are listed in the app's About / Open Source Licences screen.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected.

Specifically, we do not warrant:

• That any other user is who they say they are. Practice safe-meet protocols (public location, share live location with a trusted contact, see in-app safety tips).
• That the Service will be available in your country forever — geopolitical and regulatory factors are outside our control.
• That moderation will catch every violation. Report concerns at safety@prideconnect.lgbt.

This disclaimer does not exclude liability that cannot be excluded under applicable law (consumer-protection statutes, gross negligence, fraud).

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for all claims arising from or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) [USD/EUR threshold — to be set with legal counsel; placeholder USD 100].

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or reputation.

This limitation does not apply to liability for death or personal injury caused by negligence, fraud, intentional misconduct, or any other liability that cannot be limited under applicable law.

10. Governing law + dispute resolution

[Governing law and dispute-resolution forum — to be finalised with legal counsel before submission. Likely framework: India law for India residents (Mumbai or Bangalore arbitration seat, SIAC or ICC rules); EU member-state local law for EU residents per Rome I Regulation; UK law for UK residents; California law (San Francisco County) for US residents. Class action waiver where permitted; consumer-friendly carve-outs where mandatory.]

For EU/UK/India consumers, mandatory local-law forums apply regardless of any choice-of-law clause.

11. Changes to these Terms

We may update these Terms periodically. Material changes will be posted at prideconnect.lgbt/terms/ and announced via in-app notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
